Legal Question in Workers Comp in Arizona
Bewildered on Law for family medical leave.
ive been hurt on the job and out on workers comp for one month.Ive been notified my family insurance has been canceled. can i ask my company for a family medical leave to extend my coverage or am i eneligable for it because of the workers comp claim?

Although this is technically a question for an employment lawyer, as a specialist in workers' compensation I will tell you that I've had many clients request and get FMLA benefits after an industrial injury. Your rights under federal employment law are not diminished because your disability is work-related. Your insurance may also be subject to COBRA, which means (if you can afford it) you may have the right to pay the premiums and maintain the coverage. However, I do not believe that the FMLA requires that your employer continue to provide health insurance benefits during a period of disability.
