Legal Question in Workers Comp in Arizona

Carpal Tunnel Repair

About three months ago I had surgery for carpal tunnel which occurred as a result of keyboarding for approx 30 years. A claim was submitted to my company's insurance company over three months ago. I am still waiting for some type of reimbursement for the time off from work required for surgery and recuperation. According to the insurance company they have to do an investigation. This sounds like an inordinate amount of time for something that is so cut and dried. Is this normal?

Re: Carpal Tunnel Repair

There is no such thing as a cut & dried claim for carpal tunnel syndrome. CTS is hated by workers' comp carriers. They believe it is a fictional condition created to take their money. They will look for any and all possible alternative explanations for your symptoms. Because it sounds like you already got your surgery, they will feel very little urgency to make a decision.

Arizona law requires a carrier to accept or deny a claim within 21 days of being notified of the claim by the Industrial Commission of Arizona. If you have not received a letter from the ICA telling you that the carrier was notified, then you do not yet have a claim! You must contact the ICA for instructions on how to initiate a claim, or visit them at 800 W. Washington in Phoenix or 2675 E. Broadway in Tucson. [Their website is www.ica.state.az.us.]
