Legal Question in Workers Comp in Arizona

claim denied

I was assaulted at work (work at jail) by an inmate who has since went to prison because of it. I filed an ICA claim and have went to numerous drs. Recently I went to have an IME done and the dr says I am perfectly fine and I had previous conditions...which I never have had. They say I must return to work. I am in a great deal of pain and nothing has been resolved...my work says the case in closed and theres nothing I can do. I understand I can appeal my case, but am unsure of how that works.

You should have received a Notice of Claim Status that closed your claim. Call the Industrial Commission Claims Department if you can't find the notice. You have 90 days from the date of the notice to request a hearing. The notice explains how to request a hearing at the bottom of the page. You can also visit the Industrial Commission's website (http://www.ica.state.az.us/) to learn a lot about your rights. Talking to a lawyer would also be a good idea...most of us offer free consultations!
