Legal Question in Workers Comp in Arizona

Claim denied

I have been off of work for about 5 weeks due to a work-related injury. It is my doctor who has had me off. I was supposed be receiving physical therapy, per the doctors request, and have not, because of the worker's comp. delay. I got a notice of claims today, stating that my claim is being denied pending further medical investigation. I can also request a hearing. What does further medical investigation mean? Do you have any further advice?

Thanks.

Re: Claim denied

From what you've described, it sounds like the carrier has questions about one or more of the following: medical causation of your injuries, correlation between the injury you reported and your doctors' diagnoses, or pre-existing conditions. Medical investigation should mean that they're gathering medical records, arranging for (should be) one-time examination with a doctor of their choosing, or both. It sounds like you are definitely at a stage where legal counsel would help. (Most of us provide free consultation for you to decide if you want a lawyer.) You can reach my office at 602-253-1789, or outside Phoenix at 800-863-4449.
