Legal Question in Workers Comp in Arizona

Collecting 25% of weekly benefits.

I will be having surgery due do an accident at work soon. I was going to hire a lawyer to help with the final settlement and medical care. However he stated that if I hired him at the time of surgery, even though I know I'll be getting paid workmans comp and he had nothing to do with getting it for me. He stated he was still entitled to his fee of my weekly benefits. Is this what all worker comp lawyers do or do each one of them make their rules?

I do not believe that all Arizona attorneys charge a fee in the manner you have described. In my firm, our fees are usually a percentage of the benefits we obtain for our client. HOWEVER, not everyone will get permanent disability benefits (which is a prerequisite to potentially negotiating a lump sum settlement.) If you fall into that category, then there would be no future benefits from which an attorney could take a fee, and thus be compensated for helping you now.
