Legal Question in Workers Comp in Arizona
How do I completely settle out.
I had my back crushed on the job and have since then had four back surgeries. I want to completely settle out with workman comp. I would like a lump sum settlement so that I can pack up my family and start over some where. Is there a cap on what they will settle out for. I am willing to give up all medical if it means a large enough settlement. I just want to know what my rights are for settling out.

In Arizona, our courts and Industrial Commission have decided that injured workers cannot trade all medical benefits for money. In other words, you cannot settle in the manner you describe, unless there is a bona-fide dispute about whether the insurance company is responsible for your injury and its permanent consequences. It doesn't sound like this is the case.
You can, however, settle your future compensation and "supportive care" benefits. In order to know what those things are worth, you should consult with a qualified attorney who is a specialist in workers' compensation law.
Please do not negotiate a settlement with the insurance company or its attorney without first speaking to a lawyer. Even if you just pay someone for an hour of their time (rather than hiring them to represent you) it will be worth your while.
