Legal Question in Workers Comp in Arizona
contract drivers
my husband and i have a small trucking company. a driver that we issue a 1099, hurt himself at 5:30 in the morning didn't report any injury until the end of the day. he is reporting two different stories to the doctor and to us. are we entitled to pay workers' compensation even though he is resposible for his own taxes and medical insurance

Re: contract drivers
I represent quite a few small employers like yourselves, so I'm fairly familiar with this situation. "Employee" for tax purposes is not defined the same as for workers' compensation. If you have workers' comp insurance, your carrier should provide you with free legal consultation.
Your circumstances must be carefully reviewed by a specialist in this area of law to see if you have a defense to a claim. I suggest that you get an immediate consultation, before saying anything to anyone or taking any action. If you do not have a workers' comp carrier, you can reach my office at 602-253-1789 or 800-863-4449.
