can I file a complaint against the industrial commission?
hi there. I have read through title 20, about workers compensation. I had to file a bad faith complaint against the insurance carrier because they denied conservative treatment for an acute problem, which has to do with an excepted claim. The problem is that the complaint was sent to the industrial commission, to the address on their complaint form, but no action has been taken. Every time I call to check on the status of the complaint, the telephone representative states that the complaint is still pending, and the complaint has not been served to the insurance carrier, who the complaint is against. The complaint has been sitting with the industrial commission for several months now. Every time I call, the person I talked to direct me to the voicemail of the complaint supervisor, but she never calls me back. She never acknowledges the communication. Is there anyway to complain against the industrial commission for not taking action on the complaint, or not acknowledging communication from me as the complainant? Thank you, Maria

If it makes you feel any better, injured workers with lawyers have to tolerate long delays sometimes, as well! You can, however, try to get around the person who appears to be the problem. First, try calling the Ombudsman's office at 602-542-4538. If that doesn't work, try the Claims Manager at 602-542-4661.
