Legal Question in Workers Comp in Arizona

I was injured on1/12/2, terminated 1/16/2, Never denied or allowed benefits.

I was injured on 1/12/2 while employed in Arizona. I injured it punching a wall. I don't normally punch walls but the stress that my new supervisor was putting on me, as well as being physically threatened by a customer at the time, drove me over the edge. I was terminated by the company 6 days later. I was terminated less than 24 hours after I talked to the Human Resource Manager about my supervisor harassing me and holding me to unattainable goals. The reason for termination was totally bogus. He said that i had naked pictures up in my office when I never did. I had employees in my office all day and no pictures were ever noticed.

I know I covered several different areas but I don't know which one to concentrate on. The company's insurance carrier first told me I was going to receive payments. They then said it was under review. I have not heard from them since the first week in February.

A couple of years ago, the Arizona Court of Appeals issued an opinion which, in my opinion, was poorly-analyzed and wrongly-decided, but it's still the law. See Glodo v. Industrial Comm'n, 1 CA-IC 96-0089, COURT OF APPEALS OF ARIZONA, DIVISION ONE, DEPARTMENT D, 191 Ariz. 259; 955 P.2d 15; 253 Ariz. Adv. Rep. 24, September 30, 1997, Filed, Petition for Review DENIED on May 19, 1998 by Arizona Supreme Court CV 97-0527-PR. You can read the opinion at http://caselaw.lp.findlaw.com/data2/arizonastatecases/app1/ic960089.txt

It would appear that your situation is very similar, and that your claim would be considered non-compensable. If there are facts in your case that would distinguish it from Glodo, feel free to call me to discuss, at 800-863-4449.
