Legal Question in Workers Comp in Arizona

Is it too late for benefits ?

About 8 years ago I injured myself on the job,and was treated for a shoulder problem, with injections and therapy. recently about two years ago I started having some severe shoulder and arm pain . I've been diagnosed with four buldged disks in my neck and stenosis and degenerative disk disease troughout my entire spine. The Doctors say i must of had an accident to bring on such a condition. The only injury I've ever had is the above mentioned.I have recieved 6 epiderials, 2 mylograms, 3 MRI's,1 nevere biopsy,1 emg,1 week hospitalized for pain, 1 cervical disk fusion surgery, and now my symptons and pain are back. awaiting another mylogram. I am fearful of another surgery. And I did try chiropractics, acupunture and rolfing. I still work for the same company in a management position besides the hospital time I've taken little time off, but my condition is starting to effect my job duties , driving being one of them. a little advise please. thanks

Re: Is it too late for benefits ?

I can't tell if your original injury was accepted and paid for by workers' comp. If so, then under Arizona law you have reopening rights. Reopening is granted if you can prove you are suffering from a "new, additional or previously-undiscovered condition" that was caused or contributed to by the industrial accident. So, it's not too late if you have a claim to reopen, but you'll still need a qualified medical expert to review your old records and give an informed opinion about whether or not the current conditions are related.

A case like yours really is difficult for a non-lawyer to prepare or present. If you would like me to look at it further, I offer free consultations. You can reach me at 602-253-1789 or 800-863-4449.
