Legal Question in Workers Comp in Arizona

meeting requested while on temporary total disability

hi there. I was injured in the state of Arizona with a work-related injury. My doctor currently has me on temporary total disability and has submitted the paperwork that says that I am off of work until the next evaluation. The worker's compensation claim was accepted. However, my boss has called me and for a meeting. He wants to talk about some planning for the next quarter. My question is this: if I am on temporary total disability should I go to the meeting? Or should I not set forth at work at all. I am currently not getting the worker's compensation wages, I am using up my sick time.thank you very much, Maria

Re: meeting requested while on temporary total disability

You should not be using sick time. You need to demand temporary compensation from the carrier.

However, helping your employer with a task that is within you ability to perform is a good thing. Unless you believe that your physician would forbid you from doing so, attending a meeting like that (assuming you are physically capable of doing so) should be viewed as a good-faith effort on your part to a) assist your employer, and b) reduce your need for compensation for that month. (You will only lose $.67 in compensation for every $1.00 you are paid by the employer.)

If you are refused compensation, a workers' compensation attorney can assist you in getting help from the Industrial Commission. Feel free to contact my office at 602-253-1789 or 800-863-4449.
