Legal Question in Workers Comp in Arizona
My original orthopedic surgen took my stitches out and declared me 100% in 7 days with out a follow up or PT. Sentry Insurance who represents the company i worked for stopped my benifits. I was no where near ready to go back to work so i conatcted the Senrty rep and he told me to get a second oppinion which i did. The ortho i spoke with said that he understands why i could not go back to work so he put me on limited duty--now this would be fine if i could go back to work but since the company i worked for terminated me i did not have that option. The Senrty rep said he would have to check Az stutes to see if i could still get my benifits which i checked and i should be able to--i woudl like to know if the benifits will continue until i am released?? If this Senrty Insurance company does not wnat to cover me then i will have to sue.
Am i still covered under the workmans comp?

Your employment status does not affect your rights under workers' compensation. (Many people are no longer employed by the same company yet receive benefits for years or even for life.)
You are entitled to compensation for time lost from work due to your injury. If there are conflicting medical opinions concerning your disability, however, there might be a controversy that has to be decided by the Industrial Commission. You cannot "sue" for workers' comp benefits, but you do have the right to a hearing at the Commission. They have a website with lots of good resources. Just Google "industrial commission of arizona".
