I am a mason,been in the field for 32 yearswith a pending back operation for a bad disc removal,and fusion a doctor stated I have 5-8%disability,my question is after making $45,000.00 plus for some years now,and having to find a job at $7-8 dollars an hour,the difference between what I did make and what I can make are quit different,if my disability is 5-8% and this means 5-8% is the percentage loss of my pre-injury wages,but I've been told I'll never be able to do my job again and to find some thing else,meaning take $3000.00 to $4000.oo a year at 5-8% disability and my 8 dollar an hour job and thats it?NEVER

In Arizona, a permanent spine injury is classified as "unscheduled," which means that the percentage of impairment your doctor assigns bears no relationship to permanent disability benefits. Instead, you need to worry about the permanent limitations he places on you.
Unscheduled permanent disability benefits are based on the difference between your average monthly wage (AMW) and your post-injury earning capacity. This difference is your lost earning capacity (LEC), and you only get 55% of your LEC. Also, Arizona law places a cap on the AMW, and that cap is probably less than half of what you were really earning when injured. You are not compensated at all, for example, if a permanent unscheduled injury causes your earning capacity to drop from $100,000 to $50,000 per year! This is one of the harshest aspects of Arizona's law, but it is the case in many other states, as well.
