Legal Question in Workers Comp in Arizona
Released benefits cancelled
My wife on 9/29/2006 fell at work and has had 2 surgeries, she has recieved only two checks and the doctor has now released her ,as a result we are no longer getting any benefits, she is on home IV therapy from an infection and has a halo with bars coming from 5 places in her leg.Workmans comp is now requiring her to work and has cancelled benefits for 1 month ,they claim that when she has the final surgery they will put change her status. The doctor handling the infection has not released her, Isn't his approval required? Or just the primary doctor? what about the bills that come in the next month?

Re: Released benefits cancelled
The information you have provided certainly does not sound like your wife's case is being handled correctly (assuming there are no other issues that would permit the carrier to interrupt compensation benefits.) If your wife is unable to work and the industrial injury is either the cause or even just ONE of the causes of her disability, she should be eligible for compensation. The only way for me to give you an informed opinion about this situation, however, will be through an interview. At my office, consultations are without charge or obligation. Give us a call.
