Can an employer refuse to allow an employee the right to use a cane at work if it does not interfere with her job performance or affect her job duties. May the employer be forced to quit such harassment.

Re: employers harassment of cane use

If the condition which causes the use of the cane substantially impairs a major life activity, i.e. walking, then the employer must allow the employee a reasonable accomodation. The use of a cane would seem to be reasonable. If the cane allows the employee to perform the essential functions of her job without undue disruption or safety concerns.

I suppose there might be some situations where a cane was disruptive or could pose some sort of safety risk. Each case is different. If the situation is not covered by the ADA there may be no legal recourse. If you have any more questions, please feel free to contact me.
