Appellant Appeals and Retry!
If the Appellant appeals after conviction and wins can he/she be retried?

It depends on what the appellate court says. If they overturn the conviction, they can dismiss the case or they can remand it and allow the original prosecutor to decide whether or not to retry it.
In other words, it depends on the ruling from the appeals court.
