Legal Question in Appeals and Writs in Arkansas

Appellate Decision

If an appellate decision is not favorable what would the appelant's next step in getting ruling(s)overturned? Also, if there is a ruling for a case to be remanded does it go before the same judge in the original trial court case? I would be concerned about a vendetta as I feel the judge was very punitive in his decision of the case. I even received a letter from him telling me he 'suspects' that I fired my attorney in the trial case because of his decision, which was after my letter to him explaining the reasons why I terminated her services.

Re: Appellate Decision

Was this appeal in AR? Was it in state or federal court? In AR, if state, it would go to AR Court of Appeals. The next step would be AR Supreme Court. Then on to Federal District Court, and more. If it started in Federal Court, they have appellate court and US Supreme Court. Just depends on where it is now where it goes next. Be sure you that if you are going to appeal, you do so soon, before the statute of limits runs out.

Generally the case goes back before the same judge, if remanded.
