Legal Question in Business Law in Arkansas

working for free

Our employer requires assistant managers( who are hourly employees) to take a 30 min. unpaid lunchbreak. We are not allowed to leave the store and must be available to help employees, get change, etc while off the clock. The system is set up so that if you clock out you can't clock back in for the full 30 min. Isis correct to assume that if you ae clocked out, it is our time and we should be allowed to leave etc. as long a we return to finish our shift ?

Re: working for free

You must be paid for any time that you work. Employers cannot force you to clock out and then require you to remain on the job. You should be paid for all of that time and any other time you work but are not paid. If you would like more information on this subject take a look at my overtime website, www.overtimepaylaw.us. You should contact a wage and hour attorney to help you recover all of that time.

Probably what the employer is doing is illegal. If there are a number of employees involved in this situation, I would be interested in talking to you about the situation. If you would like to discuss this issue further with me, I can be contacted at [email protected].
