Legal Question in Civil Rights Law in Arkansas

drug testing

I work for a company who provides contract services to a hospital. The hospital, of which I am not employed audited the non narcotic medicines we check out from the hospital for each case. Only the narcotics are audited at check out and check in times. The hospital employee then insisted I take a urine drug screen in their lab( she had two security guards escorting me also.) The narcotic drugs were all accounted for , no discrepency. There was one less non narcotic Phenergan in the box than the suggested stock amt. , but it had not been audited when the box was checked out, so no way to verify the count. I asked to use the phone to call my boss for authorization. She refused to let me call him , saying that she could authorize this. I am taking prescription medication which showed up on the drug screen and the hospital is refusing to let me treat at their facility. Isn't this wrong? Do I have any recourse? They are planning to turn me over the the State Board of Nursing , where I could possibly lose my license to practice. Please help.

It does sound like you were not give adequate procedural protections with regard to this drug screening. One of the big problems with most drug screening is they do not take into consideration outside factors, such as prescription medication.

Your license is on the line. You should consult with an attorney immediately to begin the process to protect it as well as your current employment position and hospital clearances.
