Legal Question in Civil Rights Law in Arkansas
Invalid Warrant
A few weeks ago I was arrested for a probation vialation. The warrant was issued in March of 2001. In Febuary of 2002 I had turned myself in on this warrant and was sentenced to 6 months in a correctional facility. Since that time I have finished my time, completed my parol with no problems and have been doing well for myself and my three children. I was arrested on January 3, 2004, I was handcuffed and taken to jail in front of my childrem. I had to pay a bondsman 355.00 to get me out. Since this happened the city attorney has straightened everything out. There was not suppose to be a warrant for me because I had already be sentenced for that charge. But what I would like to know is there anyway to collect my 355.00 that I have actually paid for no reason. The city that failed to take the warrant out of the computer after my sentencing is not the city that I am currently living in, it is across the state from me. What can I do?

Re: Invalid Warrant
What county are you located in? Was this state or federal court? Was there any charges other than the original warrant? I would suggest writing a letter (or having a lawyer write one for you)politely requesting the money. No guarantees, but since it appears you should never have been arrested, it would be a posssibility to get the money back.
You may also want to check with the bondsman to see if they got any money back.
