Legal Question in Technology Law in Arkansas

Website Ownership Laws

Story: a woman develops an idea, and writes books and sells them on a website. This is her main source of income. The husband assisted in typing things onto the website, but had no part in writing any of the works. They seperated. Before she could get word to the web provider, he changed the password and gained control of the website. She now has no income, and is gonig to a lawyer to represent her for a divorce. He already filed for divorce. The lawyer asked to woman to look up the internet laws to save time and money. How does ownership of the website work? Does she still have ownership in this? Would this be something divided in court? Are there specific laws on this or a place I could go on the internet to read about this? Thanks

Re: Website Ownership Laws

Tell your divorce lawyer that ownership of copyrights and the website is marital property the same as your car, house or bedroom furniture and it should be treated as such. I don't think your husband should be allowed to appropriate the intellectual property to himself anymore than he could keep you from using your car. I would suggest your divorce lawyer work that into any temporary orders/injuction. By the way, I am licensed in Arkansas and if your lawyer wants to give me a call to talk more, I will be happy to talk to him about it.
