Legal Question in Credit and Debt Law in Arkansas

Collection suit over disputed medical bills

I was working with collection agency on multiple medical debts, they applied partial payment of undisputed amount to disputed debts that were several years old in order to be able to file suit for non-paymnet and statue of limitations date would change due to illegal payment. I still dispute validity of bill, but should I pay to avoid further legal action or pursue a response to claim? I know they violated FDCRA.

Re: Collection suit over disputed medical bills

I would be concerned how they were able to apply this payment to the disputed claims. You may want to let an attorney look at the paperwork that you paid from (bills, invoices, etc.). Is there some contract between you and the agency, showing what you are paying for? They may have some fine print in the deal allowing them to do this, or they may just be assuming you won't contest it.

If you can definitely prove they violated FDCRA, you may be able to get some satisfaction. A well-written letter or phone call might do it, or you may need to take legal action.

Your best scenario would be to find an attorney that would look at all your paperwork to see what can ultimately be done, and the best way to do it.
