Legal Question in Credit and Debt Law in Arkansas

Debt collection practices

I have been paying a collection agency for six months. They have yet to send me any paper work. If I stop payment until I recieve some paper work can that affect my credit situation or can I be punished in anyway for that?

...your credit is already affected because the matter was referred to the collection agency.

You may have not said whatyou meant to say. 1) you could have been talking about just one debt that some collection agency has been hounding you, and you could be talking about one of these so-called debt reorganizers.

If it is the first, then there are certain rules these guys have to follow. You should see an Attorney and ask about the FDCPA to see if he has been following the rules. On the other hand, if it is one of these reorganizers, my opinion is not good. Basically they put you through a chapter 13 bankruptcy without the protection of the bankruptcy court. Largely they take money and do little for their clients. Oh I suppose that some do accomplish quite a bit, but your credit is screwed up for a long time. In a Bcy, we can clean up your credit NOW and it has the force of the law behind it, which the reorganizers do not have.
