Legal Question in Credit and Debt Law in Arkansas

Garnishment of wages earned in Arkansas by a Texas resident

I am a Texas resident and homeowner. I borrowed money from a finance company in Texas. I cannot pay it back as agreed and am being threatened by a collection agency to have my wages garnished as I now work for an Arkansas company. Can my wages earned in Arkansas be garnished? It is my understanding that Texans' wages can only be garnished for court-ordered support payments, defaulted student loans and back taxes.

Re: Garnishment of wages earned in Arkansas by a Texas resident

If you truly are a Texas resident, and were when you earned the wages, I cannot imagine what would make your wages subject to garnishment by an ordinary creditor "at the source" (that is, in the employer's hands).

You should keep notes of each conversation that you have with the creditor concerning this, with the date, time, whom you spoke with, and what was said. You should show it to a lawyer ASAP, since some applicable statutes of limitation require that you sue within a year of the threat.
