Legal Question in Credit and Debt Law in Arkansas

my legal rights

Some 6 years ago, I obtained a private educational loan for my daughter, whose name is secondary. Some 3 years later, I was divorced, and was forced to file bankruptcy. No more statements came from this company. Nor were any bills sent to my daughter. Now over a period of a year, harassing and threatening phone calls are coming to my job and my daughters, with outrageous demands for money that we cannot possibly come up with from a collection company. Each time it is for a different amount of money, even though I paid on this for 3 years before I filed bankruptcy. This company refuses to work with us for repayment, and hangs up on us, with no room for negotiations. I am single, living on one income, and have not been able to establish anything with this horrible collection company. They have threatened us with everything, lawsuits, and taking personal property. I need to know my rights, and exactly what this collection company can do. I have never once denied owing this, but they will not work with us. What can I do?

Re: my legal rights

You need to talk with an Atty. Were they listed on your bcy and if so did they fail to object to discharge? It also sounds like they are violating the FDCPA (collections law)
