Legal Question in Credit and Debt Law in Arkansas

Stolen credit information

Recently I used my bank debit card (Visa)to reserve a room at a resort in Perryville Ark, over the telephone from my home in Texas.

My information was used illegally and traced to the managers on site names, and at least one order (using my card) was made from the Resorts phone number. And a delivery address was in the name of the site manager as well.

What are my rights? What are the owners responsibilities?

I know the bank will file charges, and prosecute if possible, but do the owners of such properties have insurance for this type transaction? Can I file a lawsuite against them personally?

The business may have a surety bond for their employees, however the bond (if any)is there to cover any uncompensated damages. Whether you can sue the business will be determined by the laws of Arkansas, and not Texas.

I think the resort was doing business in TX by advertising and accepting your reservation by phone.Although you have a legal right to sue, an attorney will usually determine your losses (damages) to decide whether or not to sue.
