Legal Question in Criminal Law in Arkansas
Can a conviction stand
My husband was convicted of calif penal code 213(a)(1)(A)x3 in 1998. My question is can a conviction stand if all three elements of the crime was put on the jury verdict forms but the jury only marked two of the elements and left the main element of voluntary act in concert blank. Was that crime proven?

I believe you need to talk to an attorney who handles appeals and specializes in that area. My practice deals with state courts thru the trial stage. That being said, it is up to the judge to look at the jury forms and make sure they are correct. If he/she didn't than maybe there's an issue. David Wallin
