Legal Question in Education Law in Arkansas

Questions to a minor

I have a student who was called to the office and held in a meeting with the assistant principal and the parents of his neighborhood friend. The parents accused him of stealing from their home the night before. The assistant principal told the parents he has a history of stealing and also refused to allow the student to call his parent. Is this legal? What should I do?

Re: Questions to a minor

Your child cannot be unlawfully detained by school personnel for an alleged crime purportedly committed during non school hours, and without a juvenile officer in attendance. The detention was unlawful, and the refusal to allow the child to call a parent was unconscionable. You need to consult with an attorney immediately. Also, the statement that the child was a thief, or words to that effect, absent some documented proof of this, is also potentially actionable. Consult a local AR attorney and find out what you can do under AR law.
