agreement and contract

should not both parties (husband and wife) be present before a lawyer to discuss what they have agreed upon?

I am not really sure of what you're seeking by your question.

Assuming your question relates to divorce or child custody (the categories you selected), it really doesn't matter if you are present when the agreement is drafted or not.

What is important, is that you READ the agreement before you sign it so that you will know if it meets what you agreed to. I would also advise that if you are the party that didn't hire the attorney to draft the agreement, that you seek an Attorney to explain it to you before you sign the document (shouldn't cost you a lot). It is better to be safe than sorry.
