Legal Question in Family Law in Arkansas
Attorney Represented us both in Divorce
I have been divorce now for 3 yrs. I have tried to get help and no one would help me.
this is my problem
Our attorney was representing us both. She was a friend to us, because my husband and myself taught her kids. She said she would help us since we had a non contest divorce. It was not contested because she never contacted me with anything going into the divorce decree, I didn't even know it was happening, untill my husband (who abused me for 23 yrs.) presented me with a decree that I had never seen. I had talked to her once about visitation for holidays and the quickclaim on house. That was it. Everything else in it was a surprise (although she was representing us both, and I have letters stating that she was representing us. Anyway, I did not agree with any of it, and he chased me downand forced me to sign it. I told her I did so under duress. It was never changed. She went by what he said and never told me anything was going on, or what was happening. I lost everything. House, business, my children.
Should she have done this to me? I feel she unethically used her position to get what he wanted, because he convinced her. When I said no, she should have stopped it all. I didn't even know when court was.

Re: Attorney Represented us both in Divorce
Based upon the facts you describe, it sounds like the attorney in question violated the Missouri rules. I am not admitted to practice in Arkansas. You should contact an attorney in the area where this case occurred, and hire them to look into your case.
Good Luck
