Changing My Child Last Name

I have sole custody of my child. I am remarried and my current husband want's to adopt the child, but both him and the biological father are overseas for the next year. I was wondering if I could change my child's last name without any other kind of consent.

Assuming the biological father is on the birth certificate or is registered with the Putative Father's Registry, you are going to have to give him notice of your intentions. Then he can consent or object. If he does not consent, you have to go through a longer process to allow your husband to adopt, if it is possible at all.

The other problem you will have is the "Soldier's and Sailor's Civil Relief Act" which says basically you have to wiit till Dad comes back from wherever he is deployed UNLESS he signs the waivers to let it happen
