child support arrears
Does the child have to live in the mothers home for her to receive support from the osce? I am paying arrears for the child but he did not live in the mothers home. Can I stop the arrears?

While the support order is current, yes the child should be living with the custodial parent, unless there are other provisions that the court was made aware of. However, arrears has nothing to do with the current situation, but with monies owed from the past. The past may have been when the child did in fact live with the custodial parent. The courts are very reluctant to vacate arrears unless there are extreme circumstances warranting such.

Arrears are for unpaid child support from a prior order or for support not paid from the time between the filing of a petition for support or a modification of support and the date that the court rules on the petition. Arrears can not be vacated accept for extremely limited grounds. It would be in your best interest to contact an experienced family court attorney and discuss your particular situation and circumstances to see if you fall into one of the few exceptions.
