Legal Question in Family Law in Arkansas
Closing Child Support Case
I have 2 children age's 9 and 11. Their father has given me papers to have signed and notorized. He says he paid a lawyer $500.00 dollars for them because he wants to stop paying support in exchange for terminating his rights. Is this even feasable? He says if I don't sign there will be no peace in my life. He has said, where the children have heard he doesn't want them at his house therefor he shouldn't have to pay. For there sakes I told him I would sign. But I've looked into it and I don't think a Judge would agree to it. What can or should I do?

Re: Closing Child Support Case
You should not sign the papers. Further, in my opinion, the agreement would not be enforced by the Court even if you did sign, although it may be subject to some equitable defenses.
Their father has an obligation to pay support to help them. If he does not, then he can be held in contempt. If he does not want visitation, you cannot make him exercise it. However, he does have an obligation to continue to pay support.
