What determines the custodial parent to be able to move out of state?

The Court will consider whether the custodial parent can move the child out of the state. There is a presumption in favor of relocation and the opposing parent has to overcome it.

The Custodial parent doesn�t have to prove advantage of moving.

Some factors court considers when determining if the relocation is acceptable are:

The reason for relocation; The educational, health, and leisure opportunities at new location; The visitation and communication schedule for noncustodial parent; The effect on the move on family relationships in the new location and AR; and The child�s preference
