Legal Question in Family Law in Arkansas

Custody vs Gaurdianship

My Husband's ex has custody of thier son but her mother has guardianship. Our lawyer told us that in order to get joint custody, which the ex is agreeing to, then we have to submit papers to have the guardianship terminated. The ex is over 18 and has full custody so I don't see how the grandmother has anything to do with it. The reason she had the gaurdianship was because the ex was under age when she had the child. Shouldn't the gaurdianship have been terminated when she turned 18. Also our lawyer is friends with the ex's mother, and he is charging us 2,100 dollars just to submit these papers, that can't be right.

Re: Custody vs Gaurdianship

The guardianship is not automatically terminated. A judge has to order it so ... sounds pricey, but then there may be more to it than it appears.
