Legal Question in Family Law in Arkansas

Custody when Mom is in addiction treatment

My friend has been addicted to Stadol for the last 3-4 years and has been in treatment(hospitals) 3 - 4 different times. She has also had an affair with a man who is also in treatment but who has been clean for 2 1/2 years. What are her chances in getting custody? By the way, she is now clean and has never jeopardized her son's health or life.

Thank you.

Re: Custody when Mom is in addiction treatment

I guess addiction to common pain medications isn't that uncommon, although according to the literature it isn't really considered a heavy hitter.

This is not a question I can readily answer. Drug problems are frequent issues in child abuse/neglect proceedings. But there is too little information here. Who is she trying to get custody from? If it is from an agency that has a temporary commitment due to a neglect/abuse action, there has to be a reunification plan (a plan of return). If it is the other parent, alot would depend on the length of time in that placement, the adjustment, age etc. of the child as well as the appropriateness of the other parent and the situation of your friend. Plus a lot depends on the jurisdiction and the prejudices of the court involved. There are just too many unknowns here.
