Death before the divorce was final
My mother was in the process of getting a divorce. Her and her husband split the belongings and separated. Nothing was filed in the courts. She passed away about two months after the separation. She took her house that she bought before they were married. Now that she has passed her husband keeps asking for more and more money from that house, her estate. It started at $15,000 and stands now at $40,000.
He is the plantiff. My mothers attorney isn't helping us at all I feel. We have asked her about probating a will and she told us she didn't do probate yet, her add in the phone book states she does probate. My question is, is there a way to legally get this divorce in the courts?

The divorce died with your mother. The law is VERY clear about that. You need to talk to a probate attorney quickly.
