Legal Question in Family Law in Arkansas

Divorce Complaint filing requirements

I am representing myself in a no-fault uncontested divorce. When I file the Divorce Complaint with the court, am I required to submit a copy of my marriage license as well (my wife has it.) Thank you for your time.

Re: Divorce Complaint filing requirements

No you are not required to attach a copy of the marriage certificate. However, the fact you had to ask worries me you do not have the knowledge to "do it yourself". AR is not an easy state in which to represent yourself, and AR does not allow "no fault" divorces for example (except in the case of 18 months separation). I would strongly suggest you at least pay an attorney to review your paperwork and give you some advice. Most towns have attorneys that will represent you in an uncontested divorce very inexpensively. You may have to use the phone book and shop around to a number of attorneys to find one in your price range. I have seen many people come to my office after failing to obtain a divorce representing themselves and losing their filing fee (now $140) only to have to start all over with an attorney. Even if your divorce is "uncontested" there may be important considerations you had not contemplated such as retirement or 401K accounts. Generally speaking you should not opperate on yourself or be your own attorney unless absolutely necessary.
