how does my mom obtain executorship of her sons estate when he did not have a will????

In CA if someone dies without a will the person is not called an executor, they are called an Administrator and the proposed administrator has to go to court to get Letters of Administration. If it was your brother who died you may have a right to some of the estate.

Where did your mother's son live? What other family does he have - wife, children? In AR, you can file a Request for Opening Intestate Estate. A person who passes without a will is considered intestate.
