What are the chances of criminal charges pending if cps determined dependency neglect case to be found untrue against me? My son is currently in Arkansas but I'm in Texas because I don't have a place to live in Arkansas. He is currently residing with his grandma since his father alleges he doesn't have a place right now. We have joint custody. He or his mother will not allow me to speak to my son nor have I seen him. My son would be in Texas with me but I have to modify the divorce decree before that can happen. I don't know what to do. HELP!!

Whether criminal charges are filed will be up to the District Attorney. If the neglect was severe, it is more likely that charges will be brought.

You can file for visitation and/or custody in the state of the child's residence for the last 6 months.
