Legal Question in Family Law in Arkansas

Possible father of child

Me and my husband have been married now for almost 3 years and have a 1 year old son. Recently we have learned that a girl from high school is accusing my husband of being the father of her 7 year old daughter. She has never contacted us regaurding this and I don't know what we should do? He did sleep with this girl, but she was dating someone else at the time. If it is his child would we be liable for back pay child support and have to pay from now on? We can barly afford to support our family now. I have heard that her husband is in the process of addopting the girl, but I just feel that we need closer and if we just ignore it it will never go away. I just wish she would have taken care of this when they were 16 instead of spreading it around now. I really need to know what our options are legaly. Thank you so much for your time.

Re: Possible father of child

If this is your husband's child, and his rights and obligations are not terminated, then yes, he is liable for child support. If the stepfather is in the process of adopting the child, then it is presumed that the child's mother wants the father's rights terminated. Then your husband is off the hook. I would advise your husband to call the lawyer for the child/her mother. Admit to nothing, but ask if he is being named as the father of the child. If so, he can voluntarily terminate his interest in the matter, so that the adoption can proceed.
