Legal Question in Family Law in Arkansas
Can Father Keep His Kids?
My hubby was advised by his divorce lawyer that he would never get cusitody of his children no matter what the circumstances are. The lawyer told him that the courts favor the mothers. So he asked for and got joint cusitody in '95. His ex exercised her rights for maybe a year. She isnt in a stable environment. My husband is all about providing stablility to his children. I have told him that no judge would take children out of a stable home that they have lived in for so long and place them into a home that is always up in the air. She has moved probably 50 times in 8 yrs. She only stays a few months then just leaves. She hasnt held a job for more then 6 months. She also has a drug problem. My question is can a good stable father who has had his children for 8 years, has provided everything they need with no help from their mother, and has provided a good stable home for his kids get full cusitody in AR? And if he did could the courts order the mother to get help for her problems so she can be a positive and consistant influance in the childrens lives?

The answer is a definite yes on full custody. on the drug issue, you have a tougher problem. It is called proof. Allegations and jumping to conclusions will not get it.
