Legal Question in Family Law in Arkansas

Geographic Restriction in divorce decree

My ex spouse is moving out of the geographic restriction that states ''can not move children from any county contiguous to Harris county Texas''. She has to move due to financial constraints and we both can not afford to re modify the existing decree. Is there an alternative to modifying the decree to the area which she is moving to, Ashdown, Arkansas?

She had stated that an affidavit would be okay but I was told that mediators would be the correct avenue to reach an agreement.

Regards.

Read again the paragraph in your decree that restricts the relocation. Usually it will provide that you can alter the order regarding geographical restrictions by written agreement. If it says so, then prepare and sign an affidavit that reflects your agreement and file it with the court. If it does not, then she can retain an attorney to file an agreed modification of the order. There are 2 free mediation services in houston.

Dispute Resolution Center

or

Domestic Relations Office

I think both have websites. The DRO is part of a larger non-profit organization.

perhaps they can mediate your issues for free.

Good luck!
