can hubbys ex- wife get custody of thier daughter

hubby got custody of daughter after her mom got homeless she has had several b/f's 2 that I know of beat her in front of the kid...she left the sate for 1 1/2 yrs didnt call her kid for 5 months at a time some times ..now shes back got a job and a place and want to go back to court to get custody. Kid wants to live w/ her and she's almost 13. but me and hubby are very stable and good providers kid loves me ''step mom'' but she still wants to live w/ mom..does mom have a chance? should her drug use and domestic violence be brought up in court if it comes to that. hubby is an alcholic but had no noticable personality change..held the same job for 10 yrs...very loving and kind.and a grat dad. thats our only fault that I can see alchol i mean. BTW kid mom stole some stuff and the cops broke in to her shabby motel room in the middle of the night and me and hubby had to pic the kid from jail..there the people dropped charges tho. and kid get sick to her stomach everytime mom calls or comes back home Dr. said it anxiaty attack. does that help? thanks--name removed--

Mom does not stand a chance if all is told. The standard is "substantial changed circumstances such that it is in the best interests of the child" not "Child wants to try something new, wah wah wah" Becides, child wanting to be with Mom is probably just puberty and inquisitiveness setting in. You will need an Atty though. Don't leave it to chance!
