Legal Question in Family Law in Arkansas
In initial divorce hearing to determine temporary child-support and visitation, the judge issued a full restraining order against the husband's new girlfriend prohibiting her from having any contact with the infant child. Custody was awarded to the mom and dad was given basic visitation rights. It was based on testimony of her overt desire to have the baby herself and a history of some drug and alcohol use. In the final divorce hearing, how likely is it for another judge to overturn the original restraining order vs. making it permanent?
