Legal Question in Family Law in Arkansas

I left my husband on December 10, 2010 and we had filed our taxes early thru HR Block the day before. He got the refund a couple of days ago and is refusing to give me any of it. He filed single head of household with our daughter and myself listed as dependants. Our divorce hearing is set for April 21, 2011. Am or am I not entitled to have of the refund?

The refund is marital property. Advise your attorney and the judge at trial and produce a copy of the tax return.
