Legal last name change
I am getting married can i change my daughter's last name to my new married name without her birth fathers consent,if he is not on birth certificate?

Probably not, especially if he has been adjudicated the father and is paying child support.
The name change has to be found by the court to be in the "best interest of the child." Probably hard to meet that standard unless there are other facts not listed.
