What if you marry on the assumpation you are divorced yet to find out later you are not divorced. So married to two people.

The rule of thumb is that if you are married without having legally ended your prior marriage, you could be committing bigamy.

What you should do as soon as possible is verifying with a competent family law attorney if you are or not legally divorced from your previous spouse. If you are not divorced, than you should get divorced from your previous spouse as soon as possible and remarry the actual spouse once the divorce is finalized.
