Legal Question in Family Law in Arkansas
Modification of Custody?
I've always had our daughter, no contesting it from my ex husband. He is very mean to me.
So when I moved to Arkansas for three years, from CA, I filed for divorce and legal custody, after being married 10 years but only together a little more than a year. I got sole custody with him having summer visits and odd Christmases
Then we moved BACK to CA in the same city we both grew up and he saw her a few times a year, but not at his house. Last summer, after I got married, and moved back to Ar, he called up demanding his six weeks with his daughter. He said he just realized that when she is 18yrs old, he can't tell her what to do with her summers.
I begged him to take her three weeks first, because she had never been with him or anyone that long.
There are things that went on at his house that were not what she is used to, and I don't like it. But how do we make it where she doesn't have to go if she doesn't want to. I don't blame her, because there is many reasons she gave me that makes me NOT want her to go either.

Re: Modification of Custody?
Was your ex-husband granted six weeks summer visitation in your divorce decree? If he wasn't he'll have to get court permission to have her that long. If he was given six weeks in the decree and has failed to maintain any contact with your daughter you may want to seek a therapist's advice as to whether or not that length of visitation would be good for her. If the therapist doesn't feel it would then you have grounds to modify your divorce decree as it relates to the summer visitation.
