What is a second-out setting and a first-out setting?

Your lawyer should answer this question for you. But the terms related to trial settings refer to the practice of seting several cases on the same day at the same time and then giving them a prioritization. Thus one out means second in line. Two out meaning third in line etc. These terms vary from state to state and court to court but are all docket management terms. Since each court is different, ask your lawyer.
